Website, coaching, education, programs and digital resources

These Terms and Conditions are entered into between you and HERSELF HEALTH Pty Ltd (ABN 57 632 565 925), trading as HERSELF HEALTH® (HERSELF HEALTH, we, us or our). They govern your use of www.herselfhealth.com and, where applicable, your purchase or use of our coaching, education, consulting, workplace wellbeing, workshops, programs and digital resources.
Please read these terms together with our Privacy Policy, Disclaimer and any specific offer, enrolment document, invoice, proposal or written program terms supplied to you.
1. Acceptance and scope
By using our website, purchasing a product or service, submitting an enrolment, or expressly accepting these terms, you agree to be bound by them. If you do not agree, do not use the relevant website, product or service.
Specific written terms provided before you purchase or enrol form part of your agreement with us. If there is an inconsistency, the specific terms apply to that product or service to the extent of the inconsistency.
We may update these website terms from time to time. Updated terms apply to future website use and future purchases from the date published. We will not use a later update to remove accrued rights or materially alter an existing paid service without appropriate notice and a lawful basis.
2. Eligibility
Our general website and adult coaching programs are intended for people aged 18 years and over, unless we expressly offer a service for a younger person with appropriate consent arrangements. You must have legal capacity to enter into the relevant agreement.
3. Nature of HERSELF HEALTH services
HERSELF HEALTH provides coaching, education, consulting, workshops, workplace wellbeing services and general information. The scope of each paid service is described in the relevant offer, proposal, enrolment information or invoice.
Unless expressly agreed as a separate clinical consultation, HERSELF HEALTH coaching and education are not medical treatment, psychological treatment or emergency care and do not establish a doctor-patient relationship. Clinical medical services provided separately by Dr Masi Njawaya through Sydney Sports Medicine Centre are governed by the clinic's clinical processes and are documented separately in its Gentu practice-management system.
Our services do not replace assessment or treatment by your own doctor, psychologist or other appropriately qualified professional. Seek personalised professional advice when required.
4. Applications, enrolment and availability
Submitting an expression of interest or application does not guarantee acceptance. We may assess suitability, capacity, scheduling and group fit before offering a place. We may accept, decline or waitlist an applicant, acting reasonably and without unlawful discrimination.
A place in a paid program is confirmed only when we issue written confirmation and receive payment by the stated deadline, unless we agree otherwise in writing. If payment is not received by the deadline, we may offer the place to another person after giving reasonable notice where practicable.
We may set minimum or maximum participant numbers. If demand exceeds capacity, we may offer a waitlist or a later cohort. We are not obliged to create an additional cohort.
5. Fees, GST, invoicing and payments
Prices will state whether GST is included. For consumer-facing HERSELF HEALTH offers, the total price payable will be disclosed before purchase. Payments may be processed through Xero, Stripe, bank transfer or another disclosed payment service.
You must pay invoices by the due date and use the requested payment reference. You are responsible for any fee that your own bank or payment provider charges you. We will not impose a payment surcharge above the amount permitted by applicable law.
If an instalment arrangement is offered, you remain responsible for payments as they fall due, subject to your rights under the Australian Consumer Law and any specific cancellation terms disclosed before purchase.
6. Cancellations, changes and refunds
Any specific cancellation, transfer or refund terms disclosed before purchase apply to that service. Nothing in those terms or these Terms and Conditions excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
We do not use a blanket 'no refunds under any circumstances' policy. However, a change of mind, failure to attend, or failure to complete activities does not automatically entitle you to a refund. Where permitted, we may offer a transfer, credit, substitute session or other reasonable solution at our discretion and having regard to the circumstances.
If HERSELF HEALTH cancels a paid service and cannot provide a reasonable rescheduled or equivalent service acceptable in the circumstances, we will provide an appropriate refund for the part not supplied. If we make a material change that substantially reduces what you purchased, we will offer an appropriate remedy consistent with applicable law.
For any subscription expressly offered as recurring, the price, billing frequency and cancellation method will be disclosed before purchase. You may cancel future renewal by following the disclosed process before the next billing date. Cancellation does not ordinarily reverse a charge for a service period already supplied, subject to applicable law.
7. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be provided with due care and skill, be reasonably fit for a disclosed purpose where the law applies, and be supplied within the agreed time or otherwise within a reasonable time.
For a major failure with a service, you may be entitled to cancel the service contract and receive a refund for the unused portion or compensation for its reduced value. You may also be entitled to compensation for other reasonably foreseeable loss or damage. For a problem that is not a major failure, we may be entitled to remedy the problem within a reasonable time.
8. Your responsibilities
You agree to:

provide information that is accurate and not misleading

make your own informed decisions and seek professional advice where appropriate

participate respectfully and comply with reasonable safety and group-conduct directions

tell us promptly if an activity appears unsuitable or creates a safety concern

not use a program, website form or ordinary email for urgent medical or mental-health assistance
-
protect any login, meeting link, workbook or participant-only resource supplied to you.
If you experience urgent symptoms, a medical emergency, or a risk of harm to yourself or another person, contact emergency services on 000 or an appropriate crisis or health service. Do not wait for a HERSELF HEALTH response.
9. Group programs, privacy and conduct
You decide how much personal information to share in a group. Other participants may hear or see what you voluntarily disclose. We will set confidentiality expectations, but we cannot guarantee another participant's conduct or absolute confidentiality.
You must not disclose another participant's personal story or identifying information outside the group without that person's express permission. You must not make an audio, video, photographic or screen recording of a session without the prior consent of HERSELF HEALTH and every person who may be captured.
We may give a reasonable direction, pause participation, remove a participant from a session, or terminate participation where reasonably necessary to address serious or repeated misconduct, harassment, unlawful behaviour, intellectual-property misuse, safety risk or a material breach of these terms. Where practicable and appropriate, we will explain the concern and allow an opportunity to respond. Any refund or credit will be determined fairly, having regard to the reason for termination, the service already supplied, specific program terms and applicable law.
10. Intellectual property and permitted use
The website and our materials, including text, videos, presentations, workbooks, diagrams, frameworks, methods, exercises, forms, branding and program content, are owned by or licensed to HERSELF HEALTH and are protected by intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use materials supplied to you for your own personal learning or authorised internal business use. This licence does not transfer ownership.
Unless we give prior written permission, you must not:

copy, reproduce, publish, sell, sublicense, distribute or publicly display substantial parts of our materials

share participant-only materials, meeting links or recordings with another person

remove copyright, trade mark or proprietary notices

use our proprietary materials or substantially similar reproductions to teach, certify, coach or sell a competing program
-
upload confidential or participant-only materials into a public artificial-intelligence system, training dataset, content library or other repository for extraction, reproduction or model training.
You may apply the ideas and skills you learn in your own life and work. Nothing in these terms prevents fair use of your own knowledge, experience and independently created material, or any use permitted by law.
11. Information and materials you provide
You retain ownership of content you provide. You give us a limited licence to store, reproduce and use it only as reasonably necessary to assess an application, deliver a service, respond to you, meet legal obligations, or as otherwise described in our Privacy Policy.
We will not publish your name, story, image, testimonial or identifiable feedback for marketing without separate permission. Any permitted use remains subject to applicable privacy, consumer and health-practitioner advertising requirements.
12. Website use
You may use our website only for lawful purposes. You must not interfere with its security or operation, attempt unauthorised access, introduce malicious code, scrape or systematically extract content, impersonate another person, harvest personal information, or use the website in a way that infringes another person's rights.
We may suspend or restrict website access where reasonably necessary for security, maintenance, legal compliance or a material breach. We do not promise uninterrupted availability.
13. Third-party services and links
Our services may use or link to third-party platforms, including Google, ActiveCampaign, Zoom, Xero, Stripe, Wix and other providers. Their own terms and privacy practices may apply. We are not responsible for independent third-party content or services outside our reasonable control, but this does not exclude responsibility that cannot lawfully be excluded.
14. Electronic communications
You agree that program notices, invoices, disclosures and other communications may be provided electronically. Marketing communications are governed by your preferences and our Privacy Policy. You may unsubscribe from marketing without affecting necessary administrative messages about a current service.
15. Educational information and outcomes
Website content, general resources and coaching education are provided for general educational purposes. Outcomes vary according to personal circumstances, health, participation, decisions, environment and factors outside our control. We do not guarantee a particular health, energy, performance, relationship, financial, professional or other outcome.
Examples, case illustrations and participant experiences are not promises that another person will achieve the same result.
16. Liability
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law, or liability that cannot lawfully be limited.
To the extent permitted by law, we are not liable for loss caused by your use of free general information contrary to an express warning, your failure to obtain appropriate professional advice, an unauthorised use of our materials, or an event outside our reasonable control.
Where the law permits a remedy for a failure to comply with a consumer guarantee to be limited, our liability may be limited, at our option, to supplying the services again or paying the reasonable cost of having the services supplied again. This limitation does not apply where it would be unfair or unlawful, or to liability that cannot be limited.
17. Your responsibility for unlawful use

o the extent permitted by law, you are responsible for reasonably foreseeable loss we suffer because of your unlawful use of the website or materials, your infringement of another person's intellectual-property or privacy rights, or your deliberate or material breach of these terms. You are not responsible to the extent the loss was caused or contributed to by HERSELF HEALTH or another person for whom you are not responsible.
18. Events outside reasonable control
Neither party is responsible for delay or failure caused by an event outside that party's reasonable control, such as serious illness, natural disaster, widespread technology outage, government restriction or other force majeure event. The affected party should notify the other where practicable and take reasonable steps to minimise disruption. This clause does not remove rights available under applicable law.
19. Concerns and dispute resolution
Please contact info@herselfhealth.com if you have a concern. We will try to understand and resolve it in good faith within a reasonable time. Nothing in this clause prevents either party from seeking urgent relief, contacting a regulator or consumer-protection body, or exercising a legal right.
If a dispute is not resolved directly, the parties may agree to mediation in New South Wales before commencing non-urgent court proceedings. Mediation is not compulsory unless both parties agree.
20. General legal terms
These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales and courts entitled to hear appeals from them have non-exclusive jurisdiction.
If part of these terms is invalid or unenforceable, it is to be read down where possible and otherwise severed without affecting the remainder. A delay in exercising a right is not a waiver. You may not transfer a paid place or your contractual rights without our consent, which will not be unreasonably withheld where a transfer is appropriate. We may transfer our rights and obligations as part of a genuine business restructure only where this does not materially reduce your rights.
